Jämförelse mellan FNs deklaration om mänskliga rättigheter och Europakonventionen om mänskliga rättigheter.

UN Article 10.

Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.

COE Article 6 – Right to a fair trial(section one)

In the determination of his civil rights and obligations or of any criminal charge against him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. Judgment shall be pronounced publicly but the press and public may be excluded from all or part of the trial in the interests of morals, public order or national security in a democratic society, where the interests of juveniles or the protection of the private life of the parties so require, or to the extent strictly necessary in the opinion of the court in special circumstances where publicity would prejudice the interests of justice.

Europakonventionen och FNs deklaration om mänskliga rättigheter överensstämmer, förutom att Europakonventionen inskränker rätten till att rättegången hålls publikt för följande fall:

  • för att upprätthålla moral, ordning och säkerhet
  • av hänsyn till unga eller till privatlivets helgd
  • om publicitet kan förväntas skapa hög press på domstolen att komma till en icke rättvis dom

COE Protocol 7, Article 2 – Right of appeal in criminal matters

  1. Everyone convicted of a criminal offence by a tribunal shall have the right to have his conviction or sentence reviewed by a higher tribunal. The exercise of this right, including the grounds on which it may be exercised, shall be governed by law.
  2. This right may be subject to exceptions in regard to offences of a minor character, as prescribed by law, or in cases in which the person concerned was tried in the first instance by the highest tribunal or was convicted following an appeal against acquittal.

Europakonventionen går något längre än FNs deklaration, men skall inte bara ha rätt att få sin sak prövad, utan även ha rätt att överklaga inför en högre domstol. Lagar skall bestämma procedurerna runt detta. Undantag får ske enligt lagregler rörande mindre brott, om första prövningen sker inför en högre domstol eller i mål gällande frigivning.

COE Protocol 7, Article 3 – Compensation for wrongful conviction

When a person has by a final decision been convicted of a criminal offence and when subsequently his conviction has been reversed, or he has been pardoned, on the ground that a new or newly discovered fact shows conclusively that there has been a miscarriage of justice, the person who has suffered punishment as a result of such conviction shall be compensated according to the law or the practice of the State concerned, unless it is proved that the non-disclosure of the unknown fact in time is wholly or partly attributable to him.

Europakonventionen ger också rätt till ersättning vid felaktiga domar. I FNs deklaration finns den allmänna ersättningen för kränkningar av mänskliga rättigheter i artikel 8.

COE Protocol 7, Article 4 – Right not to be tried or punished twice

  1. No one shall be liable to be tried or punished again in criminal proceedings under the jurisdiction of the same State for an offence for which he has already been finally acquitted or convicted in accordance with the law and penal procedure of that State.
  2. The provisions of the preceding paragraph shall not prevent the reopening of the case in accordance with the law and penal procedure of the State concerned, if there is evidence of new or newly discovered facts, or if there has been a fundamental defect in the previous proceedings, which could affect the outcome of the case.
  3. No derogation from this Article shall be made under Article 15 of the Convention.

Europakonventionen lägger till ytterligare en domstolsregel som inte har direkt motsvarighet i FNs deklaration, ingen skall kunna åtalas eller dömas för samma brott två gånger i samma stat. Att åtala eller döma i flera olika stater är alltså tillåtet. Mål får öppnas om lagregler finns för detta om nya fakta i målet blir kända eller vid felaktigheter i den domstolsprocess som följts. Artikeln skall även gälla vid krig eller allmän nödsituation.
